Legal Counsel (Data Protection and/or IP)

Depending about your profile, you will:

- ensure our companies are compliant with the General Data Protection Regulation (GDPR) working along with the DPO and data protection/IP team. You will manage along with deputy DPO and DP program manager organizational data protection and assist as regards our GDPR compliance in the companies and related businesses of the Group at headquarter level in Luxembourg and cross jurisdictions interacting with various departments (IT, ICT, products and so forth); and/or,

- ensure and develop strong policy to protect our IP portfolio (domain names, trademarks, logos, etc.) and to organise/update the latter periodically, in close collaboration with our IT and products teams; follow up on domain squatting and other type of infringements done at the expense of our online products portfolio; work closely with the rest of the legal team, tax team and products teams as regards new IP development (in house or externalised), etc.


What you will really be doing subject to your profile and experience

For Data Protection:

  • Assist DPO with communication to data subjects and/or supervisory authorities
  • Coordinate data breach response and notification procedures
  • Providing advice and recommendations on how to conduct Data Protection Impact Assessments (DPIAs); Review DPIAs
  • Advising on company’s compliance with GDPR and local data protection laws to DPO 
  • Creating guidelines, policies, systems and procedures that enforce compliance with legislation
  • Monitor data management procedures and compliance within the company/group
  • Participate in meetings with managers to ensure privacy by design at all levels
  • Adequately assess the role of entities under data protection laws (such as controller/processor)
  • Liaise with other organizations that process data on behalf of the Company/group
  • Follow up with changes in law and issue recommendations to ensure compliance
  • Identify and evaluate the company’s data processing activities, review the company’s agreements and contracts with data processors and/or draft any necessary contract with internal or external entities to cover a data processing operation
  • Participate in the data protection awareness program, by providing training and related support

For IP matters:

  • Develop and actively manage the Group’s international trademark portfolios and IP strategy
  • Expert-level knowledge of trademark and copyright issues, opportunities and best practices for companies in the digital content space
  • Ability to be responsible for all trademark and copyright-related activities for multiple business segments, including training, branding, risk assessment, maintenance and enforcement, in a fast-paced environment
  • Experience with technology licensing, open source code and intellectual property; Experience counseling a technology development organization
  • Draft and negotiate licensing agreements, hardware procurement and/or IP developement agreements, conducting open source clearance and analysis, copyright and trademark registrations, analysis and response to intellectual property disputes and infringements; review of IP contracts
  • Collaborate with in-house and outside counsel on IP-related proceedings, challenges, disputes and litigation
  • Proactively counsel all levels of the organization on IP matters, ranging from broad strategic objectives to day-to-day collaboration with and input to research and development groups and teams

Requirements

Expectations

  • Master Degree in Law/LLMm  Bar exam (CCDL or equivalent) is an asset
  • 4-5 years of post-qualified experience
  • Relevant professional experience. In particular, a combined experience of both law firm, Big Four and/or in-house practice (at least part of it in Luxembourg) would be an asset
  • Ideal candidate with legal proficiency as regards Data Protection, IP and sound knowledge of the Luxembourg and EU legislative environment and procedures (including mandatorily GDPR) as well as sound knowledge of ICT/IT terminology and environment
  • Ideal candidate with excellent drafting and communication skills as regards IP/Data protection matters, with both specialists and non-specialists recipients cross-departments (numerous interactions with product owners, project manager, ICT/IT specialists)
  • Must be able to demonstrate strong attention to details, good judgment/legal reasoning
  • Excellent communication, organizational, problem-solving and good follow-through skills with successful pattern for meeting tight deadlines
  • Capability to work independently, with a client oriented approach (proactivity and accountability driven)
  • Confident, self-starter and ability to operate and thrive in a high-paced, changing work environment
  • Must possess professional maturity to take ownership of various assignments with limited supervision and achieve results. Ability to handle confidential information. Ethical standards
  • Excellent oral and written command of English. French and/or German as strong assets. Hungarian as an additional advantage
